Terms of Service

Welcome to Spell Again! These Terms of Service ("Terms") govern your use of the Spell Again web app and related mobile applications (collectively, the "Service") operated by Crosscut Innovations, LLC ("we," "our," or "us"). Today the Service is delivered primarily as a web app; native iOS and Android builds are planned.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password.
You agree not to share your account credentials with any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your account settings or by contacting us.
A valid payment method is required to process the payment for your Subscription. You shall provide accurate and complete billing information.
3. Free Trial
Spell Again does not currently offer a free trial that automatically converts into a paid Subscription. You can begin using Spell Again on our free plan without entering a payment method. Paid Subscriptions are subject to the refund terms described below.
4. Refunds
We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with your Subscription within the first 14 days of your initial purchase, contact us at support@spellagain.com and we will issue a full refund.
After the 14-day period, refunds are issued at our sole discretion and are not guaranteed. Refunds will not be provided for partial billing periods or unused portions of a Subscription.
5. Content
Your Content
Our Service allows you to create, store, and share content such as word lists, progress data, and other materials ("User Content"). You retain ownership of your User Content.
By creating User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.
Prohibited Uses
You agree not to use the Service:
- In any way that violates any applicable law or regulation
- To transmit any material that is defamatory, obscene, or otherwise objectionable
- To impersonate any person or entity
- To interfere with or disrupt the Service or servers
- To attempt to gain unauthorized access to any part of the Service
- To use the Service for any commercial purpose without our consent
6. Children's Use
Spell Again is designed as an educational tool that may be used by children under parental or teacher supervision. Parents and teachers are responsible for monitoring children's use of the Service.
If you are under 13 years of age, you must have your parent or guardian's consent to use the Service, and they must agree to these Terms on your behalf.
When a school or teacher creates student accounts on a child's behalf, the relationship between us and the school is governed by the school-consent exception under COPPA and by a Data Processing Addendum when one is in place. 7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Crosscut Innovations, LLC and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
9. Limitation of Liability
In no event shall Crosscut Innovations, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
